Following the release of the Department of Business, Innovation and Skills’ (‘BIS’) employer’s guide to zero-hours contracts (view our news item here), Government has now published draft legislation in the form of the Exclusivity Terms in Zero Hours Contracts (Redress) Regulations 2015. The legislation outlaws exclusivity clause which are designed to prevent workers, engaged via zero-hours contracts, from working for third parties.
The draft legislation includes a right for workers to claim for unfair dismissal from their first day of employment if they are dismissed for failing to comply with an exclusivity clause. They will not need to have the usual two years’ service to claim unfair dismissal in an Employment Tribunal.
